How we carry out the activity licenses
An activity license project is a technical document required for the opening of a business or establishment. The purpose of this project is to certify that the commercial or industrial activity complies with the regulations in force, mainly in terms of safety, hygiene, environment and town planning. Obtaining an activity license is a mandatory requirement in most municipalities in order to legally start an economic activity. The general process for preparing an activity license project is described below.
1. Gathering preliminary information
The first step is to obtain the necessary information on the activity to be developed and the premises where it will be carried out. It is essential to define the type of activity (commercial, industrial, services, etc.) and the characteristics of the premises, as this will influence the technical and regulatory requirements to be met. Some activities require specific licenses, such as those related to the food, health or industrial sector, which are subject to stricter regulations.
The business owner must have the legal documentation of the property, such as the plans of the premises, the use assigned in the General Urban Development Plan (PGOU), and other relevant administrative documents.
2. Technical visit to the premises
A competent technician, usually an architect, technical architect or engineer, visits the premises to evaluate its physical and technical characteristics. During this visit, the technician collects information on aspects such as:
– Space distribution: It is analyzed whether the current layout of the premises is adequate for the type of activity to be developed.
– Electrical and sanitation installations: The electrical, plumbing and sanitation installations are checked for compliance with current regulations.
– Fire safety: It is essential to check whether the premises have the fire protection systems required by regulations (fire extinguishers, emergency exits, smoke detectors, etc.).
– Accessibility: The premises are checked for compliance with accessibility requirements for people with reduced mobility, such as ramps or elevators.
3. Preparation of the technical project
With the information obtained, the technician drafts the activity license project, a technical document that describes in detail the compliance with the regulations. The usual contents of a project include:
– Descriptive report: Detailed explanation of the activity to be carried out, the characteristics of the premises and facilities.
– Floor plans: Plans reflecting the distribution of space, facilities and safety measures adopted.
– Regulatory compliance: A technical analysis that certifies that the premises comply with the applicable urban planning, environmental, accessibility and safety regulations.
– Corrective actions: If necessary, detail the measures to be taken to bring the premises into compliance, such as improving ventilation, installing additional fire extinguishers, or modifying the layout of spaces.
4. Presentation of the project at the Town Hall
Once the project has been drafted, the technician presents it to the corresponding town hall. It is important to accompany the project with any additional documentation requested by the administration, such as plans signed by the technician, a copy of the owner’s ID card, and other certificates. In some cases, it is also necessary to pay administrative fees for the processing of the license.
5. Review and granting of the license
The City Council reviews the project to verify that it complies with current regulations. If errors or non-compliances are detected, the applicant must correct them before the license is granted. If the project is approved, the City Council grants the activity license, which authorizes the applicant to start its economic activity in a legal manner.
In summary, the process to obtain an activity license involves gathering information, a technical visit, drafting the technical project and submitting it to the City Council, which will review its regulatory compliance before granting the license.
